2.2.3 IP Protection

Jiangsu government highly emphasizes efforts to protect the Intellectual Property of the software and information service outsourcing. While earnestly implementing national IP protection policies and regulations, it continues to strengthen the IP protection system building and management practices in order to lend a good environment to push forward its software and information service outsourcing industry quickly and healthily.

i. IP Protective Measures

Jiangsu formulates local regulations including “the Jiangsu Patents Promotion Rules and Regulations” and “the Jiangsu Copyright Management Regulations” etc. It also set up IP execution hearing, technical consultation and accreditation mechanisms to push the legal building of IP protection. In the meanwhile, it continues to reinforce practices of IP protection measures.

Since 2006, Jiangsu province initiated in full scale the implementation of “the Jiangsu Promotion Plan of Authentic and Genuine Product Promise”. Now, the majority of enterprises have made the promise to the whole society to respect and protect IP. At the same time, Jiangsu reinforces the justice and law execution of IP protection and administrative protection of patents. The public security system throughout the province actively fights against the breach of IP.

Owing to the contributions done to IP protection in Jiangsu province and its key cities, the State Intellectual Property Office has recognized Suzhou, Changzhou, Taizhou, Nanjing and Zhenjiang as National Model IP Protection Cities. Jiangsu IP efforts have taken the lead in China. Meanwhile, a National IPR Park for Industrial Design in Wuxi has been set up by the State Intellectual Property Office, which will serve as a green path to efficient IPR related services. In June 2007, China's Supreme Court officially approves the IP court of the Kunshan Municipal Court to undertake IP civil cases. That indicates the IP protection in Nanjing, Suzhou, Wuxi and Changzhou is on the way of becoming more professional, standardized and legal. A good IP protection environment is taking shape.

ii. Information Security Protective Measures

Jiangsu is fully aware of that the information security has become a vital element for outsourcers to choose their outsourcing partners and they keep a close eye on the information confidentiality throughout the whole process. So, local supportive policies are made to request software and service outsourcing enterprises to receive international information security certificates and it greatly supports local enterprises to receive international certificates like ISO 27001 for information security management, ISO20000 for IT service management and SAS70 for environmental security of service providers etc. The Jiangsu Information Industry Department supports, requests and directs enterprises to adopt “the Security Measures for Working Environment”, “the Physical Security and Protection Measures for Computer Equipment”, “the Security and Protection Measures for Personal Computers”, “the Internet Security and Protection Measures”, “the Firewall Security and Protection Measures” etc. to insure their information security.
